New York has one of the most layered real estate transfer tax structures in the country. Buyers and sellers each pay multiple taxes, and New York City adds additional layers on top of state taxes. This guide explains the verified statutory rates.

New York State Transfer Tax

Under NY Tax Law Article 31 (tax.ny.gov), the state real estate transfer tax is:

  • $2 per $500 of consideration (0.40%) on conveyances exceeding $500
  • Paid by the seller (grantor)
  • Applies statewide to all real property conveyances

NY Mansion Tax (Buyer Pays — Residential Only)

An additional "mansion tax" is imposed on the buyer for residential sales at or above $1,000,000. The statewide rate is 1%; NYC has a progressive schedule:

NYC Real Property Transfer Tax (RPTT)

New York City adds its own RPTT on top of the state transfer tax. For residential property:

  • 1.00% — sales below $500,000
  • 1.425% — sales at or above $500,000
